Please read these terms carefully. By creating a seller account or submitting a listing on RideMarket, you confirm that you have read, understood, and agree to be bound by these Private Seller Terms and our Privacy Policy.

Section 01

Agreement and Parties

These Private Seller Terms ("Terms") constitute a legally binding agreement between you ("Seller," "you," or "your") and RideFirst Finance, operating the RideMarket marketplace at ridemarket.ca and ridefirstfinance.ca ("RideMarket," "we," "us," or "our"), a business based in Alberta, Canada.

These Terms govern your use of the RideMarket private seller portal, including account creation, listing submission, listing management, and all related interactions with the platform.

Eligibility

To list a vehicle on RideMarket as a private seller, you must:

Creating a Seller Account

To list on RideMarket, you must create a private seller account using a valid email address. You agree to:

One seller account per individual. Creating multiple accounts to circumvent listing limits or account suspensions is prohibited.

Listing Obligations

You are solely and fully responsible for the accuracy and completeness of every listing you submit. By submitting a listing, you warrant that:

Misrepresenting a vehicle's condition, history, or specifications to induce a buyer to purchase is a potential violation of Canada's Competition Act and provincial consumer protection legislation, and may expose you to civil and criminal liability entirely independent of these Terms.

Section 05

Title, Liens, and Legal Ownership

By listing a vehicle on RideMarket, you represent and warrant that:

Buyers are encouraged to conduct PPSA (Personal Property Security Act) lien searches before purchasing. RideMarket does not verify title or lien status on private listings โ€” this is the seller's obligation.

Listing a vehicle you do not own, that is subject to an undisclosed lien, or that has been reported stolen is a serious violation of these Terms and may constitute fraud under Canadian law. RideMarket will cooperate fully with law enforcement in such cases.

Photos and Media

Photos submitted with a listing must:

By submitting photos to RideMarket, you grant RideFirst Finance a non-exclusive, royalty-free license to display, reproduce, and syndicate those photos for the purpose of operating and promoting the marketplace listing.

This license ends when your listing is removed or your account is closed, except where the photos have already been cached or distributed through syndication partners, in which case a reasonable wind-down period applies.

Buyer Inquiries and Conduct

When buyers contact you through RideMarket regarding your listing, you agree to:

Transactions and Sales

RideMarket is a listing and discovery platform only. All transactions occur directly between the seller and buyer. As a seller, you are responsible for:

RideMarket does not process payments, hold funds, provide escrow services, or guarantee any transaction. We are not responsible for any dispute, loss, or damage arising from a private sale conducted through our platform.

RideMarket's Role and Liability

RideMarket provides a listing platform and is not a party to any transaction between a seller and a buyer. We do not:

Listing Removal and Account Suspension

RideMarket reserves the right to remove any listing or suspend any seller account at any time, without prior notice, if we determine in our sole discretion that:

Sellers whose accounts are suspended for fraud or misrepresentation are permanently banned from the platform. We reserve the right to report serious violations to law enforcement authorities.

Your Data and Privacy

We collect and use your personal information in accordance with our Privacy Policy and applicable Canadian privacy law (PIPEDA).

Specifically regarding your seller account and listings:

Intellectual Property

All platform software, design, branding, and technology comprising RideMarket is the property of RideFirst Finance. Your use of the platform does not grant you any rights to our intellectual property.

You retain ownership of original content you create (listing descriptions, your own photos). By submitting this content to the platform, you grant us the limited license described in Section 7 (Photos) and a corresponding license for listing text, for the purpose of displaying and operating the marketplace.

Indemnification

You agree to indemnify, defend, and hold harmless RideFirst Finance, RideMarket, and their officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or relating to:

Limitation of Liability

To the maximum extent permitted by applicable law, RideFirst Finance's total liability to you in connection with your use of the RideMarket seller platform shall not exceed CAD $100 in aggregate, regardless of the form or basis of any claim.

In no event shall RideFirst Finance be liable for indirect, incidental, consequential, punitive, or special damages of any kind arising from your use of the platform or any transaction facilitated through it.

The private seller listing service is provided free of charge. This limitation of liability reflects the free nature of the service and the fact that all transactions and their outcomes are entirely outside RideMarket's control.

Governing Law

These Terms are governed by the laws of the Province of Alberta and applicable federal laws of Canada. Any disputes arising under these Terms shall be resolved in the courts of Alberta, and you consent to the jurisdiction of those courts.

We encourage you to contact us first to attempt to resolve any dispute informally before pursuing formal legal action.

Section 17

Changes to These Terms

We may update these Terms at any time. When we make material changes, we will update the effective date shown above and may notify you by email if you have an active seller account. Your continued use of the seller portal after the effective date of any update constitutes acceptance of the revised Terms.

If you do not agree with updated Terms, you must remove your listings and close your seller account.
